Terms of use

1. What you are allowed to do

You may:

  • browse the online shop using a compatible web browser;
  • purchase Goods through the online shop in accordance with these Terms;
  • make temporary or cached copies of pages where this happens automatically as part of normal browser use; and
  • print or save a copy of a page for your own personal, non-commercial use.

2. What you are not allowed to do

You must not:

  • alter or interfere with the operation of the online shop;
  • copy or use material from the Site for commercial purposes without permission;
  • remove or alter any copyright, trade mark or other intellectual property notices; or
  • use the Site unlawfully, fraudulently or in a way that may damage or disrupt the Site.

3. Intellectual property rights

All intellectual property rights in the Site and its content, including text, photographs, images, graphics, logos, designs and other materials, are owned by or licensed to Bristol Aero Collection Trust and/or BAC Trading Limited unless otherwise stated.

These rights are protected by applicable intellectual property laws.

You may use the Site and its content for your own personal, non-commercial purposes only unless we have given you permission otherwise.

4. Third-party websites

The Site may contain links to websites operated by third parties.

These websites are not under our control, and we are not responsible for their content, availability or operation.

The inclusion of a link does not necessarily mean that we endorse the third-party website, its operator or any Goods or services available through it.

5. Availability of the Site and changes to these Terms

We may occasionally suspend or restrict access to the Site to carry out maintenance, repairs, updates or improvements.

We cannot guarantee that the Site will always be available or completely free from errors.

We may update the Site, our policies and these Terms and Conditions from time to time.

The Terms applying to an online purchase will be those in force at the time your order is accepted, unless a change is required by law.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

6. Placing an order

You must be at least 18 years old and legally capable of entering into a binding contract to place an order through the online shop.

When you place an order, you are making an offer to purchase the Goods in your basket subject to these Terms and Conditions.

After you place your order, we will send you an email acknowledging that we have received it.

This acknowledgement does not necessarily mean that your order has been accepted.

Your order is subject to availability and confirmation of the price.

We may be unable to accept an order where, for example:

  • the Goods are unavailable;
  • payment cannot be authorised;
  • there is an obvious error in the price or description of the Goods;
  • we are unable to deliver to the address provided;
  • we reasonably suspect fraudulent or unauthorised activity; or
  • the order breaches any purchasing restriction clearly stated on the Site.

If we are unable to accept your order after payment has been taken, we will refund the amount paid.

7. Promotional codes

From time to time, we may provide promotional or discount codes.

Unless otherwise stated:

  • promotional codes have no cash value;
  • they cannot be applied retrospectively to completed orders;
  • only one promotional code may be used per order;
  • codes may be restricted to certain Goods, customers or dates; and
  • all promotional offers are subject to availability.

We reserve the right to refuse or cancel the use of a promotional code where we reasonably believe it has been obtained or used fraudulently, unlawfully or contrary to the terms of the promotion.

Goods purchased through our online shop are primarily intended for personal use.

We reserve the right to refuse orders where we reasonably believe Goods or promotional codes are being used for unauthorised commercial resale or financial gain.

8. Product descriptions

We take reasonable care to ensure that descriptions, photographs, specifications and prices of Goods shown on the Site are accurate.

Product images are provided for illustrative purposes.

Colours may appear slightly different depending on the screen or device you are using, and manufacturers may occasionally change packaging or labelling.

Where packaging or another non-material aspect of a product changes, the Goods supplied may differ slightly from the images shown online.

We will not substitute a materially different product without your agreement.

All Goods supplied by us must be:

  • as described;
  • of satisfactory quality; and
  • fit for their usual purpose,

in accordance with your statutory rights.

9. Availability and prices of Goods

All Goods are offered subject to availability.

Adding an item to your basket does not reserve it.

If a product becomes unavailable after you place your order, we will contact you.

If we are unable to supply Goods that you have already paid for, we will refund the amount paid for those Goods.

Prices

All prices displayed on the online shop are in pounds sterling (£) and include VAT where applicable.

Delivery charges are payable in addition to the price of the Goods where applicable and will be shown on the Site and/or during checkout.

The total amount payable will be shown before you place your order.

Prices and promotions may change from time to time. Changes will not affect orders that we have already accepted.

Pricing errors

We take reasonable care to ensure that prices are correct.

If we discover an obvious pricing error before accepting your order, we may contact you and give you the option of purchasing the Goods at the correct price or cancelling your order.

If your order is cancelled after payment has been taken, we will refund the amount paid.

10. Payment

Payment for Goods and any applicable delivery charges must be made in advance.

We accept the payment methods displayed on the Site at the time you place your order.

Payments may be subject to validation, authentication and authorisation checks by your bank, card issuer or payment provider.

If your payment cannot be authorised, we may be unable to accept your order.

Where payment information is processed directly by our payment provider, we do not receive or store your full payment card details.

The taking or authorisation of payment does not by itself mean that we have accepted your order.

If we do not accept your order after payment has been taken, the amount paid will be refunded.

If you are unable to complete an online order, please contact us at:

retail@aerospacebristol.org

11. Delivery

Available delivery services, estimated delivery times and delivery charges will be shown on the Site and/or during checkout.

Goods will be delivered to the address you provide when placing your order.

Please check that your delivery details are correct before submitting your order.

Unless a different delivery period has been agreed with you, Goods will be delivered without undue delay and normally no later than 30 days after the contract is entered into.

Any delivery dates or timescales provided are estimates unless we expressly state otherwise.

We will not be responsible for delays caused by circumstances outside our reasonable control, although we will take reasonable steps to minimise the impact of any delay.

Your statutory rights relating to late or failed delivery are not affected.

For full details of our delivery options, charges and estimated delivery times, please see our Shipping Policy.

Responsibility for the Goods

Goods remain our responsibility until they are delivered into:

  • your physical possession; or
  • the physical possession of another person identified by you to receive them.

An exception may apply where you independently arrange your own carrier and that carrier was not offered by us as a delivery option.

12. Cancellation and returns

For most Goods purchased online, you have a statutory right to change your mind and cancel the contract.

You normally have 14 days from the day after you receive the Goods to tell us that you wish to cancel.

Where an order contains multiple Goods delivered separately, the cancellation period normally runs from the day after you receive the final item.

You do not need to give us a reason for cancelling.

Goods purchased in a sale or promotion have the same statutory cancellation rights as Goods purchased at full price.

For more information about returning an item and how refunds are processed, please see our Refund & Returns Policy.

How to cancel

To cancel your order, you must clearly tell us that you wish to cancel.

You can do this by contacting us at:

Email: retail@aerospacebristol.org

Or by post:

Retail Department
Aerospace Bristol
Hayes Way
Patchway
Bristol
BS34 5BZ

Please include your order number where possible.

Returning Goods

After telling us that you wish to cancel, you must return the Goods without undue delay and normally no later than 14 days after telling us that you wish to cancel.

Unless otherwise agreed, you are responsible for the direct cost of returning Goods where you are cancelling because you have changed your mind.

We recommend obtaining proof of postage.

You may examine and handle Goods in the same way that you reasonably could in a shop.

We may reduce your refund where the value of the Goods has been reduced as a result of handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.

Refunds

Where you exercise your statutory right to cancel an eligible online purchase, we will refund:

  • the price paid for the returned Goods; and
  • the cost of our least expensive standard delivery option, where required by law.

If you chose a more expensive delivery option, we are not required to refund the additional amount above our standard delivery charge.

Refunds will normally be made using the same payment method used for the original purchase unless otherwise agreed.

We may withhold a refund until we have received the returned Goods or you provide evidence that you have sent them back, whichever happens first.

Refunds will be made within the timescales required by applicable consumer law.

Goods that cannot normally be returned because you have changed your mind

The statutory cancellation right does not apply, or may cease to apply, to certain Goods.

This may include, where relevant:

  • Goods made to your specifications or clearly personalised;
  • Goods that are liable to deteriorate or expire rapidly;
  • sealed Goods that are not suitable for return for health protection or hygiene reasons once unsealed;
  • sealed audio, video or computer software once unsealed; and
  • other Goods excluded from the statutory cancellation right by law.

These exceptions apply only where you are cancelling because you have changed your mind.

They do not affect your statutory rights where Goods are faulty, damaged, incorrectly supplied or not as described.

13. Damaged, faulty or incorrectly supplied Goods

We are under a legal duty to supply Goods that conform with your contract.

Goods must, among other things, be:

  • of satisfactory quality;
  • fit for their usual purpose; and
  • as described.

If Goods arrive damaged, are faulty, are not as described or you receive the wrong item, please contact us as soon as reasonably possible.

Email: retail@aerospacebristol.org

Please provide your order details and information about the problem where possible.

Depending on the circumstances and the time that has passed since delivery, your statutory rights may include:

  • rejecting the Goods and receiving a refund;
  • having the Goods repaired;
  • having the Goods replaced;
  • receiving a price reduction; or
  • another remedy available under consumer law.

Consumers generally have a 30-day short-term right to reject faulty Goods, subject to the Consumer Rights Act 2015.

Your statutory rights and remedies may continue after the initial 30-day period.

Where Goods are returned because they are faulty, damaged, incorrectly supplied or not as described, we will bear reasonable return costs where required by law.

Nothing in these Terms limits your statutory consumer rights.

14. Warranties and liability

We primarily supply Goods for personal and domestic use. If you use Goods for commercial, business or resale purposes, we will not normally be responsible for business losses such as loss of profit, revenue or business opportunity.

We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our negligence.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

15. Events outside our reasonable control

We will not be responsible for delays or failure to meet our obligations where this is caused by circumstances outside our reasonable control, such as severe weather, industrial action or disruption to postal or transport services.

Where this affects your order, we will take reasonable steps to minimise the impact.

Your statutory consumer rights are not affected.

16. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer living in England or Wales, you can bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you can normally bring proceedings in either the Scottish courts or the courts of England and Wales.

If you live in Northern Ireland, you can normally bring proceedings in either the Northern Irish courts or the courts of England and Wales.

Nothing in this section affects any mandatory consumer rights you have under the law of the part of the United Kingdom in which you live.

17. Comments and complaints

If you have a comment or complaint about a purchase made through the Aerospace Bristol online shop, please contact us so that we can try to resolve the matter.

Email: retail@aerospacebristol.or

Post:

Retail Department
Aerospace Bristol
Hayes Way
Patchway

Please include your order number and details of your complaint where possible.

Making a complaint does not affect your statutory consumer rights.
